Terms of Service
Welcome to PDF Guide Port. The terms “we,” “us,” and “our” refer to PDF Guide Port.
PDF Guide Port operates this website and online store and provides digital products, including PDF guides and related downloadable content (the “Services”). Our store is powered by Shopify, which enables us to provide these Services to you.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy, and any other policies referenced on our website, describe your rights and responsibilities when using our Services.
By visiting our website, using our Services, creating an account, or purchasing a product from us, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our Services.
1. Access and Account
By using our Services, you confirm that you are at least the age of majority in your country or place of residence, or that you have the permission of a parent or legal guardian where required.
You agree to provide accurate, current, and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality and security of your account information and for activity carried out through your account.
2. Digital Products
PDF Guide Port sells digital products only. No physical products are shipped.
We make reasonable efforts to describe and present our digital products accurately. However, colors, formatting, layout, and appearance may vary slightly depending on your device, screen, operating system, PDF reader, or other software.
Product descriptions, prices, content, and availability may be changed or discontinued where permitted by applicable law.
Purchasing a digital product gives you a limited right to use that product for your own personal, non-commercial use unless expressly stated otherwise.
3. Orders
When you place an order, you are making an offer to purchase the selected digital product.
We may reject or cancel an order where reasonably necessary, including in cases of payment failure, suspected fraud, unauthorized transactions, obvious pricing errors, technical errors, or other circumstances permitted by law.
Payment must be successfully completed before access to the purchased digital product is provided.
Please make sure your email address, billing information, and other order information are accurate before completing your purchase.
4. Prices, Taxes, and Payment
Prices are displayed in the currency applicable to the relevant market or checkout and may change without prior notice.
The price shown at checkout is the price applicable to your order, including or excluding taxes as indicated and as required by applicable law.
You agree to provide current, complete, and accurate billing and payment information.
By submitting payment information, you confirm that you are authorized to use the selected payment method.
Payments may be processed by Shopify Payments and other payment providers made available through our checkout.
5. Digital Delivery
All products sold by PDF Guide Port are delivered electronically.
No physical shipping is required and no shipping fees apply unless expressly stated otherwise.
After successful payment, your purchased digital product will be made available electronically, for example through a download link, checkout or order-confirmation page, or email.
We use Filemonk as a digital-delivery service provider to help provide download links and access to purchased products.
You are responsible for providing a valid email address and for ensuring that your device and software are capable of opening standard PDF files.
If you experience difficulty accessing your purchase, please contact us at support@pdfguideport.com.
6. Right of Withdrawal for Digital Content
Consumers in the European Union may have a statutory right of withdrawal for distance contracts.
Where permitted by law, if you expressly consent to the immediate supply of digital content before the end of the statutory withdrawal period and acknowledge that you lose your right of withdrawal once supply or access to the digital content begins, your withdrawal right may expire once performance has started and the legally required confirmation has been provided.
If the legal requirements for loss of the withdrawal right have not been satisfied, your statutory rights remain unaffected.
Nothing in these Terms limits any mandatory consumer right that cannot lawfully be excluded or restricted.
7. Refunds
Purchases are subject to our Return and Refund Policy.
Because our products are digital and are normally made available immediately after purchase, refunds are not generally provided merely because you change your mind after the product has been delivered or accessed where the applicable withdrawal right has validly expired.
We may provide a refund or other remedy where:
- you were charged more than once for the same purchase;
- you received the wrong digital product;
- the purchased file is defective or cannot be accessed and we are unable to provide a working replacement; or
- a refund or remedy is required by applicable law.
To request assistance or an eligible refund, contact support@pdfguideport.com and include your name, order number, and the product purchased.
Nothing in this section limits mandatory statutory rights.
8. Intellectual Property and License
Unless otherwise stated, all digital products, PDF guides, text, graphics, illustrations, designs, branding, website content, and other materials available through PDF Guide Port are owned by or licensed to PDF Guide Port and are protected by applicable intellectual-property laws.
Your purchase grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use the purchased digital product for your own personal use.
Unless we give you prior written permission, you may not:
- resell, redistribute, sublicense, or commercially distribute our digital products;
- share purchased files publicly or privately with other persons;
- upload products to file-sharing, marketplace, membership, or download websites;
- reproduce or republish substantial portions of our products;
- modify or adapt our products for resale or redistribution;
- remove or alter copyright, branding, or proprietary notices;
- claim our products or content as your own; or
- use our products in a way that infringes our rights or the rights of others.
All rights not expressly granted to you remain reserved.
9. Third-Party Tools and Services
We may provide access to third-party tools, applications, payment services, digital-delivery systems, or other services that we do not directly control.
Those services may be subject to separate terms and privacy policies provided by the relevant third party.
Your use of third-party services is subject to those applicable terms and policies.
10. Third-Party Links
Our website may contain links to websites or services operated by third parties.
We are not responsible for the content, accuracy, security, policies, products, or services of third-party websites that we do not control.
You should review the applicable terms and privacy policies of any third-party website or service you use.
11. Relationship With Shopify
PDF Guide Port is powered by Shopify, which provides the ecommerce platform used to operate our store.
Sales made through our store are contracts between you and PDF Guide Port, not between you and Shopify.
Shopify may provide platform, checkout, payment, account, security, and other technical services in connection with your use of our store.
12. Privacy
Personal information collected through our Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify and uses service providers such as payment processors and Filemonk, certain personal information may be processed by those providers where necessary to operate the store, process payments, or deliver purchased digital products.
Please review our Privacy Policy for more information.
13. Feedback and Reviews
If you submit reviews, comments, suggestions, ideas, or other feedback to us, you confirm that you have the right to provide that material.
Your submissions must not infringe the rights of others, contain unlawful material, or contain malicious software.
Where permitted by law, you grant us a non-exclusive right to use submitted reviews or feedback for operating, improving, and promoting our Services.
14. Errors and Inaccuracies
Occasionally, information on our website may contain errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, or other information.
We may correct errors and update information where reasonably necessary and permitted by law.
If an error materially affects an order you have already placed, we will handle the matter in accordance with applicable consumer law.
15. Prohibited Uses
You may use our Services only for lawful purposes.
You may not use the Services to:
- violate applicable laws or regulations;
- infringe intellectual-property or privacy rights;
- distribute malware, harmful code, or malicious content;
- engage in fraud, deception, or unauthorized transactions;
- interfere with the operation or security of the website;
- collect personal information about others without authorization;
- scrape, reproduce, or commercially exploit our content without permission; or
- resell, redistribute, copy, or unlawfully share our digital products.
We may restrict or terminate access to the Services where these Terms are materially violated or where otherwise permitted by law.
16. Termination
We may suspend or terminate access to our Services where reasonably necessary, including where a user materially violates these Terms, engages in fraudulent activity, or misuses our products or Services.
Provisions that by their nature should survive termination, including intellectual-property provisions and lawful limitations of liability, will continue to apply.
17. Information and Professional-Advice Disclaimer
Our PDF guides and other digital products are provided primarily for informational and educational purposes unless a product expressly states otherwise.
We make reasonable efforts to provide useful and accurate information, but we do not guarantee that every piece of information will be complete, error-free, current, or suitable for every individual situation.
You are responsible for deciding whether and how to use information contained in our products.
Our products are not intended to replace professional legal, medical, financial, psychological, tax, or other professional advice where such advice is appropriate or required.
18. Digital Product Conformity and Statutory Rights
Nothing in these Terms excludes or limits statutory rights that apply to consumers in relation to defective, inaccessible, non-conforming, or incorrectly supplied digital content.
If a digital product is defective or cannot be accessed, please contact us so that we can investigate and, where appropriate, provide a replacement, correction, refund, or other remedy required by law.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and Services are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, error-free, or available at all times.
Nothing in this section excludes any warranty, guarantee, conformity requirement, or consumer right that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, PDF Guide Port will not be liable for indirect, incidental, special, or consequential losses arising solely from your use of the Services or digital products.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for intent, gross negligence, injury to life, body or health, or mandatory consumer-protection rights.
21. Indemnification
To the extent permitted by applicable law, you are responsible for losses or claims caused by your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.
22. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will apply to the maximum extent legally permitted or will be severed where necessary.
The remaining provisions will continue in effect.
23. Entire Agreement
These Terms of Service, together with the policies referenced herein, constitute the agreement between you and PDF Guide Port regarding your use of the Services.
Failure by us to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
24. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.
We may transfer our rights and obligations where permitted by applicable law.
25. Governing Law
These Terms and contracts concluded through PDF Guide Port are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules to the extent permitted by law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of habitual residence.
26. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our Services, business practices, legal requirements, or technologies.
The current version will be published on this page with an updated revision date.
Where required by applicable law, we will provide appropriate notice of material changes.
